By placing an order, you make an offer to purchase. Flieger Fields reserves the right to refuse to process an order in justified cases, in particular in the event of pricing errors, product unavailability, incomplete order details or suspected breach of applicable law.

Your order will not be accepted until Flieger Fields confirms its acceptance. Before accepting your order, we must receive and process your payment. Please check your order carefully before placing it, as Flieger Fields may not be able to cancel it once accepted. If we do not accept, change or cancel an order, we will attempt to notify you by contacting the email address, billing address and/or telephone number provided at the time the order was placed.

The price charged for a product or service will be the price in effect at the time the order is placed and will be stated in the order confirmation email. Unless expressly indicated otherwise, the prices stated include all applicable charges presented at the time the order is placed. Shipping costs are indicated during the ordering process. The seller benefits from a VAT exemption in accordance with applicable law.

All delivery times are estimates and are not guaranteed. We are not liable for delays caused by carriers, customs clearance or events beyond our control. The risk of loss of or damage to a product passes to the customer upon delivery of the product to the customer or to a third party designated by the customer.

The Flieger Fields names, logos, product and service names, designs and slogans are trademarks of Flieger Fields or its affiliates or licensors. You may not use such marks without the prior written permission of Flieger Fields. Shopify, its logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs and slogans within the Services are trademarks of their respective owners.

You may access client tools offered by third parties within the Services which we do not monitor and over which we have no control or influence.

Flieger Fields is supported by Shopify, which enables us to provide the Services to you. However, all sales and purchase transactions are made directly with Flieger Fields. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sale between you and Flieger Fields, including any injury, damage or loss arising from the purchase of Products and services. You hereby expressly release Shopify and Shopify's affiliates from all claims, damages and liabilities arising out of or relating to your purchase and transactions with Flieger Fields.

In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way to affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any part of the Services; (c) collect or harvest the personal information of others; (d) engage in spamming, phishing, pharming or spoofing of the Services; (e) use any robots, spiders, scraping, data gathering and extraction tools, automated devices or processes, artificial intelligence tools (such as agentic AI) or any automated or manual means to access the Services; or (f) interfere with, circumvent or bypass security or authentication features, robot exclusion headers or other measures we employ to restrict access to the Services. Furthermore, no Agent may access, use or interact with the Services if we have requested that the Agent refrain from accessing, using or interacting with any of the Services.
14.3 We may restrict, including by technical means, whether and how an Agent accesses, uses and interacts with the Services.
14.4 Agents are required to: (i) for all HTTP/HTTPS requests, specify that the request originates from an Agent and disclose the Agent's name by including the following string in the request: "Agent/[agent name]"; (ii) not conceal or hide the fact that any access, use or interaction originates from an Agent, for example by (a) mimicking human behaviour and interaction patterns or (b) completing or bypassing CAPTCHAs or measures intended to distinguish human from computer use; (iii) answer truthfully any questions or prompts intended to determine whether interactions originate from a human or a computer; (iv) not circumvent or otherwise avoid any measures intended to block, limit, modify or control whether and how Agents access, use or interact with any Shopify consumer Service.

 
SECTION 15 – TERMINATION

We have the right to terminate this agreement or to deny you access to the Services (or any part thereof) at our sole discretion at any time and without notice, and you will remain liable for all amounts due up to and including the date of termination. 
The following sections will continue to apply in the event of any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy and any other provisions which by their nature should survive termination.

This includes, but is not limited to, implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement of third-party rights.

We do not warrant, represent or guarantee that your use of the Services will be uninterrupted, timely, secure or error-free.

Some jurisdictions limit or do not permit the exclusion of liability for implied or other warranties. In such cases, the above exclusions may not apply to the extent provided by applicable law.

SECTION 17 – LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, neither the Seller nor our partners, directors, managers, employees, affiliates, agents, contractors, service providers, licensors, Shopify or Shopify's affiliates shall be liable for any injury, loss, claim or damages.

This applies in particular to direct, indirect, incidental, punitive, special or consequential damages, including but not limited to loss of profits, revenue, savings, data, costs of replacement products or services and any other similar losses.

The above limitation of liability applies regardless of the legal basis of the claim, including in particular contractual liability, tort (including negligence), strict liability or any other basis provided by law.

This limitation covers any claims relating to the use of the Services or products purchased through the Services, as well as claims arising from errors, omissions or inaccuracies in content published, transmitted or made available through the Services.

Liability is also excluded in the case of loss or damage suffered as a result of the use of any content or products made available through the Services, even if we have been advised of the possibility of such loss or damage.

 
SECTION 18 – INDEMNIFICATION
You agree to indemnify, defend and hold harmless Flieger Fields, Shopify and our affiliates, partners, managers, directors, employees, agents, contractors, licensors and service providers from any loss, damage, liability or claim, including reasonable attorneys' fees, owed to any third party by reason of or in connection with (1) your breach of these Terms of Service or the documents incorporated herein by reference, (2) your violation of any law or the rights of third parties, or (3) your access to and use of the Services. 
We will notify you of any indemnification claim, provided that failure to notify promptly will not release you from your obligation unless you have suffered material prejudice. We may control the defence and settlement of such claim at your expense, including the choice of counsel, however we will not settle any claim requiring non-monetary obligations from you without your consent (which shall not be unreasonably withheld). You will cooperate in the defence of indemnified claims, including by providing relevant documents.

 
SECTION 19 – SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service, and such determination shall not affect the validity and enforceability of the remaining provisions.

Our failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect of the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
